Terms of Service

Welcome to KiwiClub Sweden. These Terms of Service ("Terms") govern your use of our
website at lostkiwi.online and all associated services, community features,
and content (collectively, the "Platform"). By accessing or using the Platform, you agree
to these Terms. If you do not agree, please do not use the Platform.
KiwiClub Sweden is operated from Stockholm, Sweden, and is subject to Swedish and EU law.
1. Definitions
- "Platform" — The KiwiClub Sweden website (lostkiwi.online), including all features,
community tools, event listings, marketplace, and associated APIs.
- "User" / "You" — Any person who accesses or uses the Platform, whether registered
or unregistered.
- "Member" — A User who has created an account on the Platform.
- "Content" — Any text, images, links, comments, stories, listings, or other material
submitted by Users.
- "We" / "Us" / "KiwiClub" — KiwiClub Sweden, operated from Stockholm, Sweden.
2. Eligibility
To use the Platform, you must:
- Be at least 16 years old (in accordance with Swedish implementation of GDPR Article
8)
- Have the legal capacity to enter into a binding agreement
- Not have been previously suspended or removed from the Platform
If you are between 16 and 18 years old, you confirm that your parent or guardian has reviewed and agreed
to these Terms.
3. Account Registration
3.1 Creating an Account
Some features require you to create an account. When you do, you agree to:
- Provide accurate and current information
- Keep your login credentials secure and confidential
- Notify us immediately if you suspect unauthorised access
- Accept responsibility for all activity under your account
3.2 Account Security
We use industry-standard security practices (bcrypt password hashing, HTTPS encryption, CSRF protection).
However, no system is completely secure. You are responsible for choosing a strong, unique password.
3.3 Account Deletion
You may delete your account at any time by contacting us at privacy@lostkiwi.online.
Upon deletion:
- Your personal data will be deleted within 30 days (per our Privacy Policy)
- Your public community contributions may be anonymised but not removed, to preserve conversations
- Consent records are retained for 3 years for legal compliance
4. Our Services
KiwiClub Sweden provides the following services:
- Community Forum — Discussion threads, Q&A, stories, recommendations
- News Aggregation — Curated New Zealand and Sweden-related news
- Events — Event listings, ticketing, and RSVPs
- Jobs Board — Employment listings relevant to our community
- Marketplace — Classifieds for buying, selling, and renting
- Guides — Information resources about living in Sweden as a New Zealander
- Newsletter — Email updates for subscribers who have given consent
All services are provided "as is" and may be modified, suspended, or discontinued at any time without
notice.
6. User Content
6.1 Ownership
You retain ownership of the content you post. By submitting content to the Platform, you grant us a
non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and
distribute your content on the Platform and in promotional materials for KiwiClub.
6.2 Responsibility
You are solely responsible for your content. You represent that:
- You own or have the right to post the content
- It does not infringe any third party's rights
- It complies with these Terms and applicable law
6.3 Moderation
We may (but are not obligated to) review, edit, or remove User content at any time. We do not endorse any
User-submitted content.
6.4 Reporting
If you believe content violates these Terms or your rights, please report it to
hello@lostkiwi.online with:
- A link to the content
- A description of the issue
- Your contact information
7. Intellectual Property
The Platform, its design, logo, original content, features, and functionality are owned by KiwiClub
Sweden and protected by copyright and intellectual property law.
You may not:
- Copy, modify, or distribute our website code, design, or branding
- Use our logo or name for commercial purposes without written permission
- Scrape, crawl, or automatically extract data from the Platform
- Create derivative works based on the Platform
8. Events & Tickets
8.1 Event Listings
KiwiClub may list events organised by us or by community members. Event details (dates, locations,
prices) are provided as accurately as possible but may change.
8.2 Tickets & Registration
When you register for or purchase tickets to an event:
- You agree to the specific event terms presented at the time of registration
- Tickets are non-transferable unless stated otherwise
- We reserve the right to cancel events and will provide full refunds in such cases
8.3 Refund Policy
- More than 7 days before event: Full refund
- 3–7 days before event: 50% refund
- Less than 3 days before event: No refund (unless event is cancelled by us)
- Swedish consumer protection law (Konsumentköplagen) applies to all transactions
9. Marketplace & Classifieds
9.1 Listings
Users may post items for sale, rent, or trade. You agree that:
- All listings are accurate and not misleading
- You have the legal right to sell, rent, or give away the item
- Items comply with Swedish law (no prohibited goods)
9.2 Transactions
KiwiClub facilitates connections between buyers and sellers but is not a party to any
transaction. We:
- Do not guarantee the quality, safety, or legality of any listing
- Are not responsible for payment disputes between users
- Recommend using secure payment methods and meeting in safe public places
💡 Tip: For your safety, we recommend meeting in public places for
in-person exchanges and using traceable payment methods such as Swish.
10. Payments
Where the Platform accepts payments (event tickets, premium features):
- All prices are displayed in Swedish Kronor (SEK) and include VAT where applicable
- Payments are processed through secure third-party payment providers
- We do not store your full payment card details
- You agree to pay all charges incurred through your account
Swedish consumer law (Distansavtalslagen, SFS 2005:59) provides you with a 14-day right
of withdrawal for digital purchases, unless the service has been fully performed with your
prior consent.
11. Privacy & Data Protection
Your privacy is important to us. Our data handling practices are detailed in our:
By using the Platform, you acknowledge that you have read and understood these policies. All data
processing complies with the General Data Protection Regulation (GDPR) and Swedish data
protection law.
12. Limitation of Liability
12.1 Platform Availability
We strive to keep the Platform available 24/7 but do not guarantee uninterrupted service. We are not
liable for downtime, data loss, or technical issues beyond our reasonable control.
12.2 Content Accuracy
Information on the Platform (including guides, news, and community advice) is provided for general
informational purposes. It is not professional legal, financial, or medical advice.
Always verify important information from official sources.
12.3 Third-Party Links
The Platform may contain links to external websites. We are not responsible for the content, privacy
practices, or terms of any third-party sites.
12.4 Limitation
To the maximum extent permitted by Swedish law:
- Our total liability for any claim related to the Platform is limited to the amount you paid us in
the 12 months preceding the claim (or 500 SEK, whichever is greater)
- We are not liable for indirect, incidental, or consequential damages
- Nothing in these Terms limits liability for fraud, wilful misconduct, or death/personal injury
caused by negligence
13. Termination
13.1 By You
You may stop using the Platform at any time. To delete your account, contact us at
privacy@lostkiwi.online.
13.2 By Us
We may suspend or terminate your access if:
- You violate these Terms or Community Guidelines
- Your account is used for illegal activities
- We are required to do so by law
- We discontinue the Platform (with reasonable notice where possible)
13.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Sections on intellectual property,
limitation of liability, and dispute resolution survive termination.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of Sweden. Any disputes will be resolved under
Swedish law, regardless of conflict-of-law principles.
14.2 Informal Resolution
Before filing a formal complaint, we encourage you to contact us at
hello@lostkiwi.online to resolve the issue informally. We will make reasonable efforts
to respond within 14 business days.
14.3 Formal Disputes
If informal resolution fails:
- EU residents can use the EU Online Dispute Resolution platform
- Disputes may be brought before the Swedish National Board for Consumer Disputes (Allmänna
reklamationsnämnden, ARN) for consumer matters
- For all other matters, disputes shall be resolved by the courts of Stockholm, Sweden
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the "Last updated" and "Effective" dates
- We will notify registered members via email at least 30 days before changes take
effect
- For significant changes, we will display a notice on the Platform
- Continued use after the effective date constitutes acceptance
